Welcome to My Tiny Story LLC ("My Tiny Story," "we," "our," or "us"). Through our app ("Website" or "Service") we create personalized children's books and digital content using user-uploaded photographs, names, and personal information. We use generative AI technologies to create customized illustrations, avatars, audio, and text.
This Unified Legal Policy governs both:
- Your use of our website and services (Terms of Service)
- How we collect, use, store, and protect personal information (Privacy Policy)
By using our website, creating an account, uploading images, or purchasing a product, you agree to this Unified Policy, including the binding arbitration agreement.
If you do not agree, please do not use the website.
We may update this Policy from time to time. If we make material changes, we will notify you by email or through the Service. Continued use constitutes acceptance.
1. Eligibility & Minimum Age
The website is intended for use by adults aged 18 or older who reside in the United States. If you access the Service from outside the United States, you do so at your own initiative and agree that U.S. law governs your use of the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.
We do not knowingly collect information directly from children under 13.
All images of children must be uploaded by an adult who is the child's parent or legal guardian, or by another adult who has obtained the parent's or legal guardian's permission to do so. By uploading any image of a child, you represent and warrant that you have the legal authority and required parental consent to upload and use that image in connection with the Service. Uploading images of children without proper authority is strictly prohibited.
2. Accounts & Security
To use our services, you must create an account and provide accurate information.
You are responsible for:
- maintaining account security;
- ensuring your password is confidential; and
- all activity under your account.
We may disable or terminate accounts that violate this Policy. By creating an account or using the Service, you consent to receive electronic communications from us, including emails, notices, disclosures, and marketing communications (where opt-in applies). Electronic communications satisfy any legal requirement for written notice.
3. User Conduct and Content You Upload
"User Content" includes:
- photos;
- names;
- text descriptions;
- personalized messages; and
- any other materials you share with us.
You represent and warrant that:
- You own the content or have permission to use it;
- You have permission from the parents/guardians of any children depicted; and
- The content does not contain prohibited materials.
Prohibited Content includes:
- nudity or sexual content;
- weapons, violence, or self-harm;
- hate symbols or extremist imagery;
- copyrighted material you do not own;
- images, likenesses, or depictions of any individual (including public figures, celebrities, or other identifiable persons) that you are not authorized to upload or use;
- AI-generated deepfakes or manipulated images of real people without their consent;
- profanity, slurs, or offensive gestures; and
- illegal or harmful material of any kind.
We may remove or refuse content at our discretion.
You may not use our platform in any way that violates any applicable law or may harm others or others' rights. We may investigate and take action we deem appropriate, including removing or modifying User Content, suspending or terminating accounts, limiting feature access, and reporting suspected unlawful activity to law enforcement. We may cooperate with regulatory authorities or third parties as needed.
4. Your License to Us (User Content License)
By uploading User Content, you grant My Tiny Story a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process such User Content solely as necessary to:
- create, personalize, and deliver your requested products and services;
- operate, maintain, and improve the functionality, quality, and safety of the Service;
- store your content until you delete it, your account is closed, or it is no longer reasonably necessary to provide the Service; and
- develop and refine internal prompts, templates, workflows, and non-identifiable system improvements.
Marketing Use
We will not use your or your child's name, image, likeness, or personalized content in public-facing marketing, advertising, testimonials, or promotional materials without your explicit opt-in consent.
This restriction does not apply to communications sent directly to you regarding your account, prior purchases, reorders, or related offerings.
5. Our Intellectual Property & Your License to Use the Final Product
All books, art, illustrations, characters, templates, scenes, audio, and digital content we create using your content are owned by My Tiny Story LLC.
You receive a personal, non-transferable, non-commercial license to use and enjoy the final product.
You may not:
- reproduce;
- commercialize;
- distribute; or
- modify
the final product, except for personal use.
We may use non-identifiable elements of your generated content (e.g., background art, generic poses, non-personalized elements) to improve our services.
6. AI Processing & Third-Party Model Providers
We use AI services such as Gemini and may use additional or replacement providers in the future.
You acknowledge and agree that:
- User Content may be transmitted to and processed by these third-party AI providers.
- These providers operate under their own privacy and data-handling policies.
- My Tiny Story does not control how AI providers store or process data.
- We take reasonable steps to choose providers that offer training-controls where available.
- We do not authorize third-party AI providers to use identifiable images of children to train general-purpose AI models, except as required to provide the Service. We cannot guarantee that providers will not use data for model improvement as permitted under their policies.
We will provide links to our AI partners' terms when applicable.
7. Products, Printing, and Delivery
Our products include printed books, e-books, audiobooks, digital files, and future multimedia products.
We use third-party printers, including Lulu, and reserve the right to change vendors.
No Guarantee of Delivery Time
We do not guarantee delivery dates. Production and shipping times depend on third-party vendors.
Refund Policy
Because products are personalized we do not offer refunds, although we will replace defective or incorrectly produced items. You are responsible for reviewing digital previews before ordering.
8. Payment Processing
Payments are processed by third-party processors such as Stripe. We do not store full payment card information.
9. Data We Collect
We collect:
- account information (name, email, password, etc.);
- order information (address, phone number, payment metadata);
- User Content (photos, names, messages);
- usage data and analytics; and
- cookies or tracking technologies (reservations to use Google Analytics, Meta Pixel, etc.).
All child-related data comes only from adults and not from children directly.
We may process and store data in the United States and in other jurisdictions where our providers operate. By using the Service, you consent to these transfers, which may involve different data protection standards than your own jurisdiction.
10. How We Use Data
We use data to:
- operate and deliver our services;
- create personalized books and content;
- communicate with you regarding your account, orders, customer support inquiries, and service-related notices;
- recommend reorders, updates, sequels, variations, or related products based on your prior purchases or created content;
- send marketing or promotional communications subject to required consent and opt-out;
- improve safety, quality, and performance;
- comply with legal obligations and enforce our rights; and
- prevent fraud, abuse, and misuse.
We do not sell personal data.
Recommendations and communications with you related to your prior purchases are considered part of providing the Service and are not public-facing marketing.
11. Data Sharing
We share data only with service providers necessary to operate our business, including:
- AI model providers;
- hosting providers;
- analytics tools;
- customer service tools;
- email providers;
- payment processors; and
- printing/drop-shipping vendors (e.g., Lulu).
We do not share data with advertisers or marketing partners.
12. Data Retention
Unless required by law or you delete your account, we retain:
- uploaded photos;
- generated books;
- account information;
- order history; and
- email logs.
Retention lasts until you delete your account or remove content.
Deletion requests will be completed within 30 days, except where retention is required or permitted by law, including:
- pending orders;
- fraud prevention; and
- legal obligations.
13. Data Security
We use reasonable administrative, technical, and physical safeguards. We restrict employee access on a need-to-know basis. However, no system is perfectly secure. You use the service at your own risk.
14. User Rights
As a U.S.-only service:
- You may delete your account;
- You may remove content;
- You may opt out of marketing; and
- You may request deletion of personal data.
We do not provide:
- data export; or
- correction of generated or User Content beyond deletion.
The rights described in this section apply only to users residing in the United States.
15. Arbitration & Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Resolution
Before initiating arbitration, you agree to first contact us at support@mytinystory.com and provide a brief description of the dispute and your requested resolution. We will attempt to resolve the dispute informally within thirty (30) days.
Binding Arbitration
If a dispute is not resolved informally, any claim, dispute, or controversy arising out of or relating to this Policy or the Service (including the formation, performance, or enforcement of this Policy) shall be resolved by binding arbitration, rather than in court, except as provided below.
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this section.
Arbitration Procedures
- The arbitration will be conducted by a single neutral arbitrator.
- Arbitration may be conducted by telephone, video conference, written submissions, or in person, as determined by the arbitrator.
- The arbitrator shall apply Delaware law, consistent with the Federal Arbitration Act.
- The arbitrator may award any relief that would be available in a court of law on an individual basis.
Fees and Costs
We will pay the arbitration filing fees and arbitrator fees for claims that qualify for consumer arbitration under the AAA rules, unless the arbitrator determines that your claim is frivolous or brought for an improper purpose.
Class Action Waiver
YOU AND MY TINY STORY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.
Exceptions
Either party may bring a claim in small claims court if the claim qualifies and remains on an individual basis. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened misuse of intellectual property or unauthorized access to the Service.
Waiver of Jury Trial
You and My Tiny Story waive any constitutional or statutory right to a trial by jury.
Survival
This arbitration agreement shall survive the termination of your account or use of the Service.
16. Limitation of Liability
To the fullest extent permitted by law:
- My Tiny Story LLC's total liability is limited to the amount you paid for the product;
- We provide the service "as-is" and "as-available"; and
- We disclaim all implied warranties.
Because AI is used, visual inconsistencies or unusual artifacts may occur. You are responsible for reviewing previews before purchasing.
17. DMCA Notice
If you believe content on the Service infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act ("DMCA").
Your notice must include:
- A physical or electronic signature of the copyright owner or authorized agent;
- Identification of the copyrighted work claimed to be infringed;
- Identification of the material that is claimed to be infringing and information sufficient to locate it;
- Your contact information (address, telephone number, email);
- A statement of good faith belief that the disputed use is not authorized; and
- A statement made under penalty of perjury that the information is accurate and you are authorized to act.
